These terms apply to the Nurturnal website, app, API, accounts, public sharing features, and related services.

These Terms and Conditions govern your use of Nurturnal, including our marketing website, web or mobile app experiences, API, account features, public profile pages, public collections, plant-sharing and matching tools, and related services we make available.
By accessing or using Nurturnal, you agree to these terms. If you do not agree, do not use the service.
You are responsible for making sure your use of Nurturnal is lawful where you live and for providing accurate account information when you register, sign in, or update your profile.
You are also responsible for protecting your login credentials, any connected social sign-in access, and all activity that happens under your account. If you believe your account has been compromised, contact us promptly.
You agree not to misuse Nurturnal or use it in ways that interfere with other users or the service itself.
You keep ownership of the photos, profile details, collection entries, notes, wishlist details, and other content you submit to Nurturnal. However, you give us the rights needed to host, store, reproduce, process, adapt, display, and share that content as necessary to operate and improve the service according to your settings and actions.
If you enable a public profile, create public collection pages, or mark plants as available for sharing or cuttings, that information may be visible to other users and, in some cases, publicly accessible on the web.
You are responsible for the content you post and for making sure you have the rights to upload and share it.
Nurturnal helps users discover one another, manage wishlists, find possible matches, and coordinate plant or cutting exchanges. Nurturnal does not take possession of plants, process exchanges on your behalf, or act as a broker, shipper, or marketplace operator for your individual transactions.
Users handle their own exchanges, including deciding whether to meet locally, arrange shipping, or use other exchange methods. We do not guarantee plant condition, listing accuracy, user identity, exchange completion, shipping outcomes, legality, safety, or the behavior of other users.
If you choose to meet or exchange with another user, use caution, follow applicable law, and prioritize safe, public-place meetups where appropriate.
Plant care guidance, propagation tips, plant identification results, and similar informational features are provided for general information only. They may be incomplete, outdated, or inaccurate for your specific plant, environment, or situation.
You are responsible for deciding how to care for your plants and whether to rely on any guidance, identification result, or recommendation provided through Nurturnal.
Nurturnal may rely on third-party providers for services such as social sign-in, analytics, hosting, storage, image handling, email delivery, and plant identification. Your use of certain features may also be subject to the terms and policies of those third parties.
We are not responsible for third-party services or for changes they make to their products, policies, availability, or security practices.
Nurturnal may offer paid plans, premium tools, subscriptions, or other paid features. If you choose a paid offering, you agree to pay the fees, charges, and applicable taxes disclosed to you at the time of purchase.
By starting a paid plan, you authorize Nurturnal or its payment providers to charge the payment method you provide for the selected plan and any renewals that apply. Pricing, billing intervals, included features, and renewal timing may change over time, and we may provide notice where required by law or where we believe it is appropriate.
Unless otherwise stated for a specific offer or required by law, cancellations stop future renewals, but amounts already billed for the current period are generally non-refundable.
Nurturnal and its branding, logos, design elements, software, service content, and related materials are owned by Nurturnal or its licensors and are protected by applicable intellectual property laws.
These terms do not give you ownership of Nurturnal or permission to copy, reproduce, distribute, modify, or commercially exploit our materials except as allowed by law or with our written permission.
We may suspend, restrict, remove, or terminate access to accounts, content, or features if we believe there is a violation of these terms, abuse of the service, safety or security risk, fraudulent behavior, legal exposure, or another legitimate operational reason.
You may stop using Nurturnal at any time. Provisions that reasonably should survive termination, such as rights relating to user content, disclaimers, and limits on liability, will continue to apply.
Nurturnal is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory.
We do not guarantee uninterrupted access, successful matches, accurate public listings, error-free operation, or that the service will always be secure or available at a particular time.
To the fullest extent permitted by law, Nurturnal and its affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity.
This includes losses arising from user interactions, plant exchanges, shipping issues, in-person meetups, public-sharing features, plant identification results, or third-party services. Nothing in these terms limits liability to the extent such limitation is not allowed by applicable law.
We may update these Terms and Conditions from time to time. If we do, we may update the effective date above and, when appropriate, provide additional notice through the website, app, email, or other service communications.
Your continued use of Nurturnal after updated terms become effective means you accept the revised terms.
